In no event shall our total liability to you exceed one hundred U.S. dollars ($100.00). Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitation or exclusion may not apply to you.

5. Intellectual Property

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be enforced to the maximum extent permissible, and the remaining provisions of these Terms shall remain in full force and effect. The failure of either party to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
